In this Case, the plaintiff was injured as a result of medical malpractice – failure to properly diagnose a severe infection resulted in the plaintiff losing his leg. The plaintiff secured experienced counsel who, after several years of litigation, was able to obtain a $500,000 settlement from multiple tortfeasors. During the course of litigation, counsel engaged Synergy to negotiate a pre-mediation resolution agreement with Rawlings. Synergy was able to develop a graduated repayment schedule so that counsel was able to effectively negotiate the underlying case. As a result of Synergy’s close involvement with counsel, when the graduated repayment schedule was created it was skewed in favor of the likely result of the malpractice Case. As anticipated by Synergy, the final resolution of the underlying case resulted in zero repayment to the self-funded ERISA plan. The savings to the plaintiff was over $2,100,000.00.
