Is Medicare cutting of future injury care for liability settlements?

CMS/MSPRC sends out an inquiry letter to one of our clients almost two years after settlement which says “Medicare’s records show that you have health insurance through a Liability Case.”  It goes on to ask about a description of the illness.  This is an apparent attempt to make sure the buden isn’t shifted to Medicare post settlement.

From Roger Baron: AZ federal court refuses to freeze assets held by plan participants so as to support ERISA plan’s claim for equitable relief

The ERISA Plan in Blood Systems v. Roesler, No. CV-11-02133-PHX-ROS, (U.S.Dis. Az., 11/2/12) sought a TRO and Preliminary Injunction freezing assets held by plan participants and their attorneys.  This decision denies the plan’s requested TRO and Preliminary Injunction sought against the plan participants.
